Every renter, operator, and passenger agrees to this before heading out. You'll initial each section and sign electronically when you book.
Big Duck Tug Boat Adventure · Big Duck Rentals. This Waiver and Release Agreement applies to all renters, operators, passengers, and users of equipment provided by Big Duck Rentals.
The rental equipment is a 9-foot long by 5-foot wide tug boat powered by a 15 hp Honda outboard motor. The maximum capacity of the vessel is 400 lbs total (maximum 2 adults + 2 small children). Renter agrees to disclose all operators, passengers, and users of the equipment. The undersigned is also signing this Release on behalf of any minor children under their care.
The undersigned acknowledges that watersport activities involve risks, including but not limited to: changing water flow, tides, currents, wave action, collisions with other vessels or objects, capsizing, sinking, wetness, hypothermia, drowning, equipment failure, operator error, wind, weather, marine life, and other hazards. The description of these risks is not complete and unknown or unanticipated risks may exist.
The undersigned voluntarily assumes all risks of personal injury, illness, damage, or loss (including death) that may result from renting, operating, or using the equipment, even if such risks arise out of the negligence or fault of Big Duck Rentals.
By signing this Release, the undersigned voluntarily releases, forever discharges, and agrees to indemnify and hold harmless Big Duck Rentals from any and all liability for injury, damage, or loss arising from the rental, operation, or use of the equipment, EVEN IN THE EVENT OF NEGLIGENCE by Big Duck Rentals (except for gross negligence or intentional acts). Each trip is fully insured through our per-trip insurance provider (Buoy) for your safety and protection.
Alcohol is permitted only for passengers 21 years of age and older. The designated driver (person operating the tug) must remain completely sober. No glass bottles or containers are allowed on the boat for safety reasons. We reserve the right to refuse service or cancel the trip if anyone appears impaired.
The undersigned agrees to indemnify and hold harmless Big Duck Rentals for any injury or damage to third parties caused by the rental, operation, or use of the equipment.
The undersigned has read this Release, understands its contents, and signs it voluntarily. The undersigned acknowledges that they may rent from another company but has chosen Big Duck Rentals with full knowledge that this Release is required.
